1. Policy

Real estate photographs, floor plans, video, virtual tours, and listing descriptions are generally protected by copyright. It is our policy to respond expeditiously to properly submitted notices of claimed infringement and, in appropriate circumstances, to disable or terminate access for repeat infringers.

2. Filing a Notice of Claimed Infringement

If you believe material available on this website infringes your copyright, please send a written notice to our Designated Agent that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

• A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
• Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
• Identification of the material claimed to be infringing, including the full URL and enough detail to permit us to locate it.
• Your name, mailing address, telephone number, and email address so we may contact you.
• A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.

4. Our Response

Upon receipt of a compliant notice, we will remove or disable access to the identified material and make a reasonable effort to notify the party who supplied it. We may forward notices concerning MLS-sourced content to the applicable multiple listing service, including the San Antonio Board of REALTORS® (SABOR), or to the listing broker responsible for the content.

5. Counter-Notification

If you believe material was removed or disabled by mistake or misidentification, you may send a counter-notification to the Designated Agent containing: your physical or electronic signature; identification of the removed material and its prior location; a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification; your name, address, and telephone number; and a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the complaining party. We may restore the material within 10 to 14 business days unless we first receive notice that a court action has been filed.

6. Repeat Infringers

We will, in appropriate circumstances, disable access for users or contributors who are determined to be repeat infringers.
